Applicability
These terms of service apply to all use of EmailWarmup.app, a software product offered by Tynka, based in the Netherlands. By creating an account or using the EmailWarmup.app application, you agree to these terms. If you do not agree, please do not use the service.
The service
EmailWarmup.app is a web-based application that automatically builds and maintains the sender reputation of your email accounts. This includes sending warmup emails through a network of real businesses, monitoring your reputation score, checking your DNS settings, scanning blocklists, and rescuing emails from spam. The service is provided on a subscription basis.
Account registration
To use EmailWarmup.app, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised access.
Acceptable use
You may use EmailWarmup.app only for lawful purposes and in accordance with these terms. You must not use the service to warm up accounts used for sending spam, unsolicited bulk email, or any communication that violates applicable law. Tynka reserves the right to suspend or terminate accounts that violate these conditions.
Network policy
By connecting an email account to EmailWarmup.app, you agree to participate in the warmup network. Your account will receive warmup emails from other businesses in the network. Marking these emails as spam constitutes a network violation. Accounts that accumulate three violations are removed from the network.
Subscription and billing
EmailWarmup.app is offered on a monthly subscription basis. Plans are priced by the number of email accounts you connect. Payments are processed via Stripe. Subscriptions renew automatically unless cancelled before the end of the billing period.
Cancellation and refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods, except where required by applicable law.
Data and privacy
Your use of EmailWarmup.app is also governed by our Privacy Policy, which is incorporated into these terms by reference. To perform the warmup service, EmailWarmup.app accesses your email account. We do not read, store, or share the content of your personal emails.
Intellectual property
EmailWarmup.app and all associated software, designs, and content are the intellectual property of Tynka. You are granted a limited, non-exclusive, non-transferable licence to use the service for its intended purpose. You may not copy, modify, distribute, or reverse-engineer any part of the service.
Availability and uptime
Tynka endeavours to keep EmailWarmup.app available at all times, but cannot guarantee uninterrupted availability. Scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary unavailability. We will communicate planned downtime where possible.
Limitation of liability
To the fullest extent permitted by law, Tynka shall not be liable for any indirect, incidental, or consequential damages arising from your use of EmailWarmup.app, including but not limited to loss of business, email deliverability issues, or data loss. Our total liability to you shall not exceed the amount you paid for the service in the three months preceding the claim.
Changes to these terms
Tynka reserves the right to modify these terms of service at any time. Changes will be published on this page with an updated date. Continued use of EmailWarmup.app after changes are published constitutes acceptance of the revised terms. We will notify registered users of material changes by email.
Governing law
These terms are governed by the laws of the Netherlands. Any disputes arising from these terms or your use of EmailWarmup.app shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands.
